TJ Maxx Class Action Lawsuit
The TJ Maxx group lawsuit, filed against the nationwide Stores (also referred to as The Discount Drug Store) accuse the company of falsely advertising their products. They say that the comparison rates between the products were calculated using an invalid method and this has caused the lower price to be advertised but not actually being offered. Additionally, the discount drug store contends that the plaintiffs did not give authorization for the comparison rates to be used. Also, they say the plaintiffs did not disclose any of the information about the conditions that the product was designed for. This is a common practice within the discount drug industry.
Now, I don’t know about you, but that sounds like a pretty big violation of what we believe should be a free market. And in class action lawsuits you have your opportunity to have your day in court to argue your case and make a case. So when you see the top class actions being called into question, whether it’s by the plaintiffs or defendants, remember that you have some opportunities. This is especially true if you’re representing the common person who is the target of a defamation suit or perhaps someone who was the victim of discrimination.
One of the things that is often overlooked is the role that the media has in this situation. Yes, many of the print and television news stories focus on class action lawsuits, wrongful death settlements, etc.. But they often do not discuss the role that the press plays.
