The Class Action Lawsuit Against For-Profit Colleges

In March, 2021, a Lawsuit was filed in U.S. District Court in Washington, D.C. by Xerox Corporation. Details: Xerox Corporation, that leases some of its expensive equipment from its contract printer, has filed suit against Ryan Tate Publishing, claiming defaults on an existing promissory note and re-ructuring lease and service agreement.

In early March, Mr. Tate informed Xerox that he was considering options with respect to resolving the dispute between him and the company. On March 8, Mr. Tate met with his lawyer and discussed a potential resolution in which Mr. Tate would allow Xerox access to certain of his properties and pay some of his delinquent bills. Mr. Tate remained optimistic.

Tate Publishing Class Action Lawsuit

On March 9, Mr. Tate’s attorney, Robert G. Kaplan, wrote a letter to Mr. Tate stating that he had written to Mr. Tate’s previous lawyer indicating that Mr. Kaplan was working on contingency and that, if Mr. Tate’s problem with Xerox was not resolved, Kaplan would file a new lawsuit against Mr. Tate. Mr. Tate responded to the letter and provided a written reply on March 10th, stating that he was not signing any agreements with either party and that he would seek legal advice from anyone who could assist him in resolving the dispute.

On March 11, Mr. Kaplan received a letter from Mr. Edward M. Ezell, a partner in the New York City law firm of Doe, LLC advising Mr. Ezell that Mr. Ezell could instruct his law firm to support Mr. Tate’s claim. Mr. Ezell’s letter also advised Mr. Ezell to obtain a new lawsuit filed against Mr. Tate.

At this point, Mr. Ezell and his law firm are linked with the late Larry Griswold, who was a former associate justice of the Supreme Court. Mr. Griswold died in a car crash on October 16, 2021.

A large number of prominent lawyers, including Mr. Tate, were traveling on private jets to attend the funeral of Mr. Griswold. Mr. Ezell’s link with Mr. Griswold comes from his role as a mediator in the massive college admissions bribery scandal at Yale University. Mr. Ezell has represented Mr. Griswold’s family in their suit against the University of Yale and currently serves as a mediator in the current case.

Mr. Ezell is a former practicing trial lawyer who has made his career suing and defying employers, banks, the Federal Trade Commission, the Internal Revenue Service, the State of California, the United States Department of Justice, United States Attorneys, and other prominent figures, including Duke University lacrosse, Duke University baseball, the Duke Lacrosse Massacre, falsely accusing a white officer of brutality in the Duke University lacrosse incident, and his representation of O.J. Simpson in his criminal case.

He has represented both treason and Simpson’s families in their lawsuits against the three major television networks and is currently representing Tiger Woods in his case against longtime friend James Woods.

Mr. Ezell is also a plaintiff and mediator in a massive class-action civil lawsuit that was filed against the State of Texas for its failure to fix the school board election process which caused many minority students to be excluded from voting in the upcoming Texas Statewide elections.

This lawsuit was later dropped by the courts, but Mr. Ezell will continue to pursue his case through the appeals process. In another class-action lawsuit he filed against the State of Arizona for its refusal to reform its failed public education system. The case was later dismissed without prejudice, but the plaintiffs are not satisfied with the dismissal of their case.

Mr. Ezell’s personal lawsuit against the Arizona State Board of Education was rejected by the court, but he is appealing the court’s decision to the United States Supreme Court.

If successful, this class action lawsuit will represent thousands of Arizona citizens who were wrongfully excluded from public schools. Proponents of the lawsuit have argued that the scandals surrounding the for-profit colleges is proof that these schools are fraudulently misrepresenting themselves as legitimate colleges when in reality they are not. These arguments are currently before the courts in an attempt to have the suits dismissed. There is no timetable set in regards to the lawsuit.
